UPGRADING TO BITUMEN STANDARD AND PERFORMANCE BASED ROUTINE MAINTENANCE OF ROADS UNDER 2020/2021 BATCH 4

The Kenya Rural Roads Authority (KeRRA) is a state corporation established under the Kenya Roads Act 2007, with the responsibility of management, development, rehabilitation and maintenance of Rural Roads.

The Authority hereby invites bids from eligible construction companies on behalf of the Ministry of Transport, Infrastructure and Housing and Urban Development to bid for the Upgrading to Bitumen Standard and Performance Based Routine Maintenance of various Roads under 2020/2021 Batch 4 as shown below and set to be financed by the Government of Kenya through the Development Vote.

  1. All Tender Documents have been amended and the revised documents are available for downloading free of charge from the Authority’s website kerra.go.ke as from 9th March, 2021.
  1. Bidders are free to participate in all tenders from RWC 607 to RWC 623.
  1. To enhance Equity, Bidders and their JV Partners can only be awarded Two (2) Tenders in RWC 607 up to 623. (The criteria will depend on the Combination that is most advantageous to the Authority).
  1. Due to specific nature of design and Build, RWC 624 is exempted from the above award restrictions.
  1. Foreign contractors are required to seek registration with the National Construction Authority after issuance of an award letter and before signing the contract with the procuring entity and should only undertake construction works or projects with a value limit of category NCA 1. The registration certificate and practicing license issued is specific to the contract being undertaken.
  1. Errors in the pricing of the Bills of Quantities will not be corrected. Bidders with such errors will be disqualified.
  1. Due to COVID-19, MANDATORY Pre-bid site visits shall be held on agreed dates and times with the respective Regional Deputy Directors and Bidders are required to have the Certificate of Bidder`s visit to site signed by the respective Regional Deputy Directors. Contact details for the Regional Deputy Directors are available on the Authority’s Website.
  1. Completed tender documents should be enclosed in plain sealed envelopes, clearly marked with the Tender Name, Tender Number and deposited in the Tender Box located on Ground Floor, Barabara Plaza Block B, or be addressed and posted to the below address on or before the respective dates and time given in the above table.
  1. Opening of the bids will take place immediately thereafter (from the respective dates and time) at the Ground Floor Board Room, Barabara Plaza, Block B in the presence of the tenderers or their representatives who choose to attend.
  1. Bids not received at the submission venue by the closing date and time will not be accepted for opening and will be rejected and returned unopened.
  1. The Authority will strictly adhere to Government guidelines on management of COVID 19. Bidders who choose to attend the opening of bids ceremony are therefore required to only send one (1) representative. This will reduce on congestion and crowding of the opening venue.
  1. The responses to clarifications sought by bidders are hereby attached.

SOUGHT CLARIFICATIONS

RESPONSE

1.        

In Appendix to form of Bid, the amount of Performance Security under Clause 10.1 is mentioned as

10% of Bid Sum 1 and 20% of Bid Sum 2 and in other cases 5% for both Bid Sum 1 and Bid Sum 2.

This has been harmonised where there were errors and all performance security is 5%.

Bidders are advised to download the amended documents from the KeRRA website.

2.        

RACECA through their letter Ref: SH/0837/KSG/PM/AJA.011 dated 18th February, 2021 requests the Authority to comply with Clause 157 (8) of the Act of 2015 PPADA.

·Clause 157 (8) – all projects funded by the Government of Kenya be exclusively reserved for its locals.

As a mandatory requirement under preliminary Evaluation foreign bidders should note the following.

1. For the purpose of section 157(9) of the PPADA,2015, all foreign tenderers participating in international tenders to source at least forty percent of their supplies from citizen contractors prior to submitting a tender.

2. For greater certainty supplies under section 157(9) of the Act shall include goods, works, non-consulting and consulting services pursuant to Section 165 of the Regulations,2020 of the PPADA, Act 2015.

3. All foreign contractors must source at least forty percent of their supplies from citizen contractors and must submit an agreement demonstrating the same as a declaration of compliance together with their tender. This requirement will form part of the Contract.

4. A citizen contractor is a person or a firm wholly owned and controlled by persons who are citizens of Kenya.

5. Foreign contractors bidding as JV Partners must be registered under NCA 1OR 2 OR NCA 1 Registerable

6. All Citizen Contractors bidding as JV partners must be registered under NCA 1 or 2.

RACECA through their letter Ref: SH/0837/KSG/PM/AJA.011 dated 18th February, 2021 requests the Authority to comply with Clause 157 (9) of the Act of 2015 PPADA.

·Clause 157 (9) – mandatory requirement as preliminary evaluation criteria for all foreign tenderers participating in international tenders to enter into a Joint Venture (JV) with a citizen contractor where at least 40% of works in terms of value shall be undertaken by the citizen contractor. A fully registered JV agreement executed according to Registration of Documents Acts must be submitted together with their tender. This requirement will form part of the Contract.
