(ADDENDUM NO. 1)

 

PROVISION OF MOTOR VEHICLE INSURANCE SERVICES - TENDER NO. KeRRA/08/38/02/ 2021 – 2022

Reference is made to the Tender Notice that appeared in the Authority’s website and the Daily Nation dated Monday 9th August, 2021.

Interested and eligible bidders are requested to note the following Clarifications and Amendments to the Tender for Provision of Motor Vehicle Insurance Cover;

  1. That Section III part 3 of the Evaluation and Qualification Criteria under the Tender Document has been amended to include the following:
  1. PRELIMINARY EVALUATION CRITERIA

Bidders should provide proof of compliance with thresholds specified in the document covering the following;

  • Certified Copy of Certificate of Incorporation / Registration
  • Proof of Principal Place of Business (Lease agreement or rental agreement/ ownership title for premises/water bill, electricity bill indicating business permanent premises).
  • Certified Certificate from Commissioner of Insurance for the current year (2021).
  • Certified Certificate of Registration as a member of AIB/AKI for the current year (2021).
  • Must have a Bank guarantee of at least 5 Million deposited with the Commissioner of Insurance and a Copy be submitted. (Provide certified copy or confirmatory letter from Commissioner of Insurance).
  • Current (dated within 12 Months before date of opening) Certified CR12 Certificate from the Registrar of Companies. This should be provided with Identification Documents of Directors. (ID or Passport). For Corporate Directors identification documents for the corporate Director and it’s directors MUST be provided.
  • Copy of PIN Certificate
  • Copy of Valid Tax Compliance Certificate (Will be confirmed through TCC checker with KRA)
  • Certified Copy of Valid Single Business Permit related to this line of Business) from County Governments.
  • Audited accounts for the last three (3) financial years (2020, 2019 and 2018).
  • Tender validity period of Two Hundred Ten (210) days from the tender opening date.
  • Provide a Tender Security of 500,000.00 in the required format. The tender guarantee (security) will remain in force up to and including Two Hundred Ten (210) days after the date of bid submission.
  • Must provide proof that the underwriter has paid up capital of at least 300 Million.
  • Must provide proof that the underwriter has Annual Gross Premium of at least 200 Million. (Provide copies of award letters and contracts.)
  • Duly filled Confidential Business Questionnaire.
  • Bidders must not have been declared ineligible by the PPRA as described in ITT 4.6
  • Submit a written power of attorney authorizing the signatory of the bid to commit the Bidder Executed by a Commissioner for Oaths, in accordance with ITT 21.3.
  • Declare conflicts of interest in accordance with ITT 4.3; provide a sworn-in affidavit executed by a Commissioner for Oaths specific to this tender.
  • Bidders should have their documents paginated (serialized) to ensure compliance with section 74 (1) (i) of the Public Procurement and Asset Disposal Act, 2015. This should be in the format 1,2,3,4,5 ……. up to Last Page).
  • All forms provided in the tender document must be properly and dully filled with the relevant information as required.

1)            

History of Non-Performing Contracts

Non-performance of a contract did not occur within the last Five (5) years prior to the deadline for application submission based on all information on fully settled disputes or litigation. A fully settled dispute or litigation is one that has been resolved in accordance with the Dispute Resolution Mechanism under the respective contract, and where all appeal instances available to the applicant have been exhausted.

2)

Pending Litigation

No pending litigation shall in total represent more than Thirty Percent (30%) of the Applicant's net worth and shall be treated as resolved against the Applicant.

Experience

3)

General Experience

Experience under provision of Motor Vehicle Insurance to Reputable Corporate Clients in the role of Underwriter for at least the last Five [5] years prior to the applications submission deadline. Provide copies of recommendation letters, award letters and contracts of the same.

4)

Specific Experience

Participation as a provider of Motor Vehicle Insurance to Reputable Corporate Clients in at least Five (5) contracts within the last Five (5) years with a cumulative value of at least Kshs. 200 Million (Two hundred million), that have been successfully and substantially provided and that are similar to the proposed cover. The similarity shall be based on the physical size, complexity, methods/technology or other characteristics as described in Section VI, Description of services. Provide copies of award letters and contracts.

Financial Capacity

Must provide proof that the underwriter is financially stable. (Provide audited accounts for the last three (3) years); (2020, 2019 & 2018)

Financial Performance

Submission of audited balance sheets or if not required by the law of the applicant's country, other financial statements acceptable to the Employer, for the last three [3] years to demonstrate:

(a) the current soundness of the applicant’s financial position and its prospective long-term profitability, and

(b) capacity to have a minimum cash flow amount of KShs. 500 Million equivalent working capital

Average Annual Gross premium

Minimum average annual gross premium for Motor Vehicle Insurance of KSh. 750 Million, calculated as total certified payments received for contracts in progress or completed, within the last three [(3)] years

List the total Exclusions provided in the cover (Provide Proof).

List all the benefits provided in the cover (Provide Proof).

Indicate the least period used to settle previous claims upon presentation of proper documents. (Provide Proof).

  1. FINANCIAL EVALUATION CRITERIA

Bidders who are responsive after the detailed evaluation will be subjected to error check and completeness. Errors in the Price Schedule will not be corrected. Bidders with such errors as prescribed in the ITT will be disqualified.

  1. POST QUALIFICATION
  1. In case the tender was subject to post-qualification, the contract shall be awarded to the lowest evaluated tenderer, subject to confirmation of pre-qualification data, if so required.
  1. In case the tender was not subject to post-qualification, the tender that has been determined to be the lowest evaluated tenderer shall be considered for contract award, subject to meeting each of the following conditions;
  1. The Tenderer shall demonstrate that it has access to, or has available, liquid assets, unencumbered real assets, lines of credit, and other financial means (independent of any contractual advance payment) sufficient to meet the cash flow of Kenya Shillings 500 million.

 

  1. Minimum average annual gross premium for Motor Vehicle Insurance of Kenya Shillings 750 million, equivalent calculated as total certified payments received for contracts in progress and/or completed within the last 3 years.

 

  • At least Five (5) contract(s) of a similar nature (Motor Vehicle Insurance) executed within Kenya, or the East African Community or abroad in the last five (5) years, that have been satisfactorily and substantially completed as a prime contractor, or joint venture member or sub-contractor with a value of Kenya shillings 200Million.
  1. That the Schedule of Tendered Items and Prices has been amended to include additional Seven (7) vehicles and Provisions for Contingencies. Contingencies provided for in the Price Schedule must be indicated and will only be used as and when required but subject to the Employers written approval. Bidders should note that the Schedule of Tendered Items and Prices provided under this Addendum No. 1 will take precedence. The Schedule is attached below as Annex 1.
  1. Bidders are advised to download Addendum No. 1 from the Authority’s website kerra.go.ke.
  1. The submission dates for the Tender for Provision of Medical Insurance Cover (Inpatient and Outpatient) for KeRRA’s Board and Staff Members – Tender No. KeRRA/08/38/01/ 2021 – 2022 & Provision of Motor Vehicle Insurance Services – Tender No. KeRRA/08/38/02/ 2021 – 2022 has been revised from 27th August, 2021 to 31st August, 2021 on or before 11.00am.
  1. Completed tender documents should be enclosed in plain sealed envelopes, clearly marked with the Tender Name, Tender Number and deposited in the Tender Box located on Ground Floor, Barabara Plaza Block B, or be addressed and posted to the below address on or before the respective date and time given above.
  1. Bulky Tender Documents which do not fit in the Tender Box shall be delivered to the reception office located on the Ground Floor, Barabara Plaza, Block B.
  1. Opening of the bids will take place immediately thereafter (from the respective dates and time) at the Ground Floor Board Room, Barabara Plaza, Block B in the presence of the tenderers or their representatives who choose to attend.
  1. Bids not received at the submission venue by the closing date and time will not be accepted for opening and will be rejected and returned unopened.
  1. The Authority will strictly adhere to Government guidelines on management of COVID 19. Bidders who choose to attend the opening of bids ceremony are therefore required to only send one (1) representative. This will reduce on congestion and crowding of the opening venue.
  1. The Performance Security will be in the form of a demand Bank Guarantee" in the amount of 10% (Ten percent) of the Accepted Contract Amount.
  1. The Contract for this tender shall run for a Period of Two (2) years. The Contract shall commence from 1st November, 2021.
  1. All other information pertaining to this tender remains unchanged.
